Terms of Service
These Terms of Service (“Terms”) govern your use of the tutoring services, website, platform, and related offerings provided by Aromatic Education, LLC (“Aromatic,” “we,” “us,” or “our”). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Limited Scope of Services
Aromatic provides tutoring, coaching, academic support, platform features, session recordings, and related offerings, whether delivered live, asynchronously, or through digital or online means (“Services”). The Services are intended to supplement your own learning and are not a substitute for your academic work. Any information, feedback, or guidance provided by Aromatic, including any of its tutors is for educational purposes only and reflects the tutor’s professional judgment. Tutors may have differing instructional approaches. You remain solely responsible for how you apply the material and for completing your academic work in full compliance with all applicable academic policies, including your institution’s codes of conduct, honor codes, course requirements, program or departmental rules, and your professors’ instructions.
2. No Guaranteed Results
Aromatic does not guarantee any specific academic outcome, grade, score, or performance on any assignment, exam, project, or course. Your academic success depends on your own effort, engagement, and compliance with your institution’s academic policies.
3. Academic Integrity
You agree not to request, encourage, or pressure any tutor to engage in academic misconduct, including completing assignments, writing papers, taking exams, impersonating you, or violating any applicable academic policies, rules, requirements, or instructions issued by your school, academic program, department, or professors. You are solely responsible for ensuring that your use of the Services complies with your school’s academic integrity policies. Aromatic may immediately suspend or terminate services for any attempt to violate academic integrity rules.
4. FERPA Disclaimer
Aromatic is a private tutoring service provider and is not an educational institution subject to the Family Educational Rights and Privacy Act (“FERPA”). Tutoring session recordings, notes, or related materials created or maintained by Aromatic are not “education records” under FERPA. Your school does not have access to these materials unless required by law.
5. Intellectual Property & Prohibited Uses
All tutoring materials, session content, examples, videos, recordings, derivative data, and related resources are the sole property of Aromatic. You may not copy, record, screenshot, distribute, publish, reverse-engineer, sell, or create competing services based on any Aromatic content without prior written consent.
6. User Conduct
You agree to treat tutors and staff with professionalism and respect. Aromatic may suspend or terminate your access to Services for abusive, harassing, discriminatory, threatening, or otherwise inappropriate conduct.
7. Privacy Policy
Your use of the Services is also governed by Aromatic’s Privacy Policy, which is incorporated by reference into these Terms, and which sets forth details on how your information is collected, used, and protected. The full Privacy Policy is available at https://aromaticprep.com/privacy-policy.
Aromatic may collect the following categories of information:
(a) Personal Information You Provide:
- Name
- Email address
- Phone number
- Payment information (processed by third-party payment processors; Aromatic does not store full credit card numbers)
(b) Tutoring Session Data:
- Audio and/or video recordings of tutoring sessions
- Chat logs or message transcripts
- Files, screenshots, or study materials exchanged during sessions
(c) Technical Data:
- IP address
- Device type
- Browser type
- Usage information
- Cookies or analytics data (as applicable)
Aromatic uses your information to:
- Provide the Services
- Schedule and manage tutoring sessions
- Process payments
- Improve tutoring quality and platform functionality
- Ensure safety, training, and quality assurance
- Communicate with you about scheduling, support, or updates
- Send text messages related to scheduling, session reminders, and account notifications (if you have opted in)
- Develop, train, test, or improve machine-learning or artificial-intelligence technologies, using anonymized or de-identified session data and recordings
- Comply with legal obligations
Recordings may be used to:
- Train, supervise, and evaluate tutors
- Monitor quality and compliance
- Improve internal processes and Services
- Develop and refine AI or machine-learning models
- Create anonymized or de-identified datasets
- Share anonymized or de-identified recordings or derivative data with third-party partners, researchers, or technology developers
- Protect Aromatic’s legal rights or comply with legal obligations
Recordings and derivative data are the exclusive property of Aromatic.
Aromatic will not publicly post or distribute recordings in a manner that identifies you without your written consent.
Aromatic may share personal information with:
- Independent-contractor tutors who provide Services
- Service providers (e.g., payment processors, cloud storage vendors)
- Communications service providers (e.g., SMS/text messaging platforms) solely for the purpose of delivering messages you have opted in to receive
- Technology partners for AI/ML development (anonymized/de-identified data only)
- Legal authorities if required by law, subpoena, or court order
We do not sell identifiable personal information. Any licensing, transfer, or sale of tutoring session recordings or derivative data will occur only in a form that is anonymized or de-identified. Aromatic will require any purchaser, licensee, or data partner to enter into a written agreement prohibiting the use, attempt to use, or attempt to re-identify any personal information contained in the data. All external partners must agree to maintain appropriate safeguards to prevent re-identification and to use the data solely for approved research, technology development, or machine-learning purposes.
Mobile Information Sharing Prohibition: No mobile information (including mobile phone numbers) collected as part of any text messaging opt-in will be shared with or sold to third parties or affiliates for marketing or promotional purposes at any time. Mobile opt-in data and consent will not be shared with any third parties for purposes unrelated to providing the Services.
Aromatic may retain personal information and recordings for as long as reasonably necessary to:
- Provide the Services
- Comply with legal obligations
- Maintain business records
- Train or evaluate machine-learning models
- Develop or improve future Services
Aromatic uses commercially reasonable safeguards to protect personal information but cannot guarantee absolute security. You use the Services at your own risk.
Depending on your state of residence, you may have certain rights regarding your personal data, such as:
- Access
- Correction
- Deletion
- Opt-out of certain uses of data
- Portability
Aromatic may update this Privacy Policy at any time. Your continued use of the Services after changes are posted constitutes acceptance of the revised Policy.
8. Scheduling, Cancellations, and Refunds
All scheduling, cancellation, and refund policies are set forth on Aromatic’s website or provided at the time of booking. By using the Services, you agree to follow those policies. Unless otherwise stated, all fees are nonrefundable once a session begins.
9. Limitation of Liability
To the maximum extent permitted by law, Aromatic is not liable for any direct, indirect, incidental, consequential, or special damages arising out of or related to your use of the Services, including – but not limited to – your performance or outcomes on any assignment, quiz, exam, project, paper, course, academic evaluation, or academic program. Aromatic is not responsible for any academic penalties, reduced grades, failed courses, loss of academic standing, program dismissal, disciplinary actions, or other academic consequences. Aromatic’s total liability for any claim arising from the Services shall not exceed the amount you paid for the specific session giving rise to the claim.
10. No Warranties
The Services are provided “as is” and without warranty of any kind, whether express or implied. Aromatic does not warrant that tutoring will meet your expectations, improve your academic performance, or satisfy any requirements of your educational institution.
11. Governing Law and Venue
These Terms and any dispute arising out of or relating to the Services shall be governed by the laws of the State of Maryland, without regard to conflict-of-law principles. Any legal action or proceeding shall be brought exclusively in the state courts located in Montgomery County, Maryland.
You irrevocably consent to the personal jurisdiction and exclusive venue of such courts, waive any objection based on forum non conveniens, and waive any right to remove or transfer any dispute to federal court, except to the extent federal jurisdiction is mandatory under applicable law.
12. Modification of Terms
Aromatic may update these Terms at any time by posting an updated version on its website. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
13. Termination
Aromatic may suspend or terminate your access to tutoring services at any time for violation of these Terms or for conduct that Aromatic determines to be harmful, abusive, or disruptive. Termination does not entitle you to a refund unless otherwise stated in Aromatic’s refund policy.
14. Entire Agreement
These Terms, together with the Outcome Disclaimer & Student Responsibilities, the Recording Disclosure & Consent, the Text Messaging Consent & Disclosure, and any additional written policies referenced herein, constitute the entire agreement between you and Aromatic regarding your use of the Services. The Outcome Disclaimer & Student Responsibilities, the Recording Disclosure & Consent, and the Text Messaging Consent & Disclosure are hereby incorporated into these Terms by reference.
15. Text Messaging Consent & Disclosure
Consent to Receive Text Messages. By providing your mobile phone number and opting in, you consent to receive text messages from Aromatic Education, LLC (“Aromatic”) related to scheduling, session reminders, account notifications, and support communications. You understand that:
- Message frequency varies based on your use of the Services.
- Message and data rates may apply depending on your mobile carrier and plan.
- Consent to receive text messages is not a condition of purchasing any services from Aromatic.
- Text messages may be sent using an automated system.
Opt-Out. You may opt out of receiving text messages at any time by replying STOP to any message you receive from Aromatic. After opting out, you will receive a single confirmation message and will no longer receive text messages from Aromatic unless you opt in again.

Message and Data Rates. Message and data rates may apply. Please consult your mobile carrier for details about your messaging plan. Aromatic is not responsible for any charges imposed by your carrier.
No Mobile Data Sharing. No mobile information (including mobile phone numbers) collected as part of the text messaging opt-in will be shared with or sold to third parties or affiliates for marketing or promotional purposes at any time. Mobile opt-in data and consent information will not be shared with any third parties for purposes unrelated to providing the Services.
Supported Carriers. Messages may not be available on all carriers. Aromatic is not liable for delayed or undelivered messages.
Consent to Electronic Agreement. By checking the opt-in box or otherwise indicating your consent, you affirmatively agree to receive text messages from Aromatic and acknowledge that this electronic consent has the same effect as a signed written agreement.
Outcome Disclaimer & Student Responsibilities
1. No Guaranteed Results. Aromatic Education, LLC (“Aromatic”) does not guarantee any particular academic outcome, grade, score, or performance on any assignment, exam, course, project, or academic evaluation.
2. Support, Not Substitution. Aromatic provides tutoring, coaching, and academic support services intended to supplement your own learning. You remain fully responsible for completing your coursework, assignments, and academic obligations in accordance with your school’s policies.
3. No Academic Misconduct. Aromatic tutors do not complete assignments, take tests, write papers, or otherwise engage in any activity that could violate your institution’s academic integrity rules. You agree not to request or pressure tutors to engage in prohibited conduct.
4. Consent to Electronic Agreement. By checking this box, you affirmatively indicate your agreement to these terms and acknowledge that this electronic consent has the same effect as a signed written agreement.
Recording Disclosure & Consent
1. Recording of Tutoring Sessions. You understand and agree that Aromatic Education, LLC (“Aromatic”) may audio-record and/or video-record tutoring sessions for quality control, training, supervision, and internal business purposes.
2. Consent to Recording. You voluntarily consent to the recording of all tutoring sessions in which you participate. You understand that you may decline to turn on your camera, but the audio portion of each session may still be recorded.
3. Ownership of Recordings. All recordings are the sole and exclusive property of Aromatic. You acknowledge that:
- You have no ownership rights in the recordings;
- The recordings are not “educational records” maintained on your behalf;
- Aromatic has full discretion regarding storage, deletion, or internal use of the recordings.
4. Permitted Use of Recordings. Recordings of tutoring sessions may be used by Aromatic Education, LLC (“Aromatic”) for educational, operational, training, quality-assurance, safety, and product-development purposes.
Aromatic may also use, analyze, reproduce, modify, or create derivative works from the recordings, including for the development, training, evaluation, or improvement of machine-learning models, artificial-intelligence systems, analytics tools, or related technologies. Aromatic may share or license anonymized or de-identified recordings or derivative data to third-party service providers, researchers, or technology partners for these purposes.
Aromatic will make reasonable efforts to remove names and direct personal identifiers before any such external sharing. Because audio and video recordings can contain inherently identifying features, Aromatic will require any purchaser, licensee, or data partner to enter into a written agreement prohibiting the use, attempt to use, or attempt to re-identify any individual, and requiring the implementation of safeguards to prevent re-identification.
Aromatic will not publicly post or distribute recordings in a manner that identifies you without your express written consent.
You understand and agree that all recordings and any derivative data are the sole and exclusive property of Aromatic, and you waive any claims to compensation arising from Aromatic’s permitted use of the recordings as described herein.
5. No Right to Copy or Distribute. You may not copy, download, record, publish, or distribute any portion of a tutoring session, including the audio, video, or content shared during the session, without Aromatic’s prior written consent.
6. Release of Claims. To the fullest extent allowed by law, you release Aromatic and its tutors from any claims arising out of the creation, use, storage, or deletion of tutoring session recordings, except in cases of willful misconduct.
